Welcome to Scripture Duck (“Scripture Duck,” “we,” “our,” or “us”), a service operated by Tinibo LLC. These Terms and Conditions (“Terms”) govern your use of the Scripture Duck mobile application, website, and related services (collectively, the “Service”).

By downloading, accessing, creating an account, purchasing a subscription, receiving access through a family subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility, Age Requirements, and Parental Supervision

Scripture Duck is intended for a general audience.

Certain features—including account creation, journaling, online interactions, cloud synchronization, subscriptions, purchases, and social functionality—are available only to users who are at least 13 years old or the minimum age required in their jurisdiction.

Scripture Duck does not knowingly collect personal information from children under the age of 13 without appropriate consent. If we become aware that personal information from a child under 13 has been collected in violation of applicable law, we will take reasonable steps to delete such information.

If you are a parent or legal guardian and you provide a minor with access to the Service, including through a family subscription or shared access code, you represent that you are authorized to do so and that you consent to the minor’s use of the Service under your supervision.

Parents and guardians are responsible for supervising minors’ use of the Service and for any activity associated with family subscription access codes they generate or distribute.

2. Description of the Service

Scripture Duck is a Bible memorization and educational game platform that may include:

Features, content, pricing, subscription benefits, rewards, and availability may change over time without notice, subject to applicable law and platform policies.

3. Accounts and Guest Access

Certain features may require a registered account. If you create an account, you agree to provide accurate information, maintain the security of your account, keep your login credentials confidential, and accept responsibility for activity under your account.

You must promptly notify us if you believe your account has been accessed without authorization.

We reserve the right to suspend or terminate accounts that violate these Terms or that are associated with fraud, abuse, security risks, or unlawful conduct.

3.1 Guest Access

The Service may allow users to access certain features, including shared family subscription features, without creating a registered account (“Guest Access”). When using Guest Access, progress and data may be tracked using a unique identifier stored locally on your device or associated with your current app installation.

Guest Access is more limited than a registered account. Guest Access data may not be recoverable, transferable, or synchronized across devices.

4. Family Subscription Access Codes

Family subscription purchasers may be able to generate or distribute shared access codes that allow family members to access certain premium Service features (“Subscriber Privileges”).

Access codes are intended only for authorized family members or other users permitted by the applicable subscription plan. You may not sell, publicly post, broadly distribute, or misuse access codes.

Tinibo LLC reserves the right to limit, revoke, rotate, suspend, or disable family subscription access codes if we believe they have been misused, shared beyond the intended group, obtained fraudulently, used to circumvent payment, or otherwise abused.

Users who access Subscriber Privileges through Guest Access should understand that their data may be linked only to their current device installation and may be permanently lost if the Service is deleted, local app data is cleared, the device is lost, or the local identifier is otherwise removed.

6. Virtual Currency and Virtual Items

The Service may include virtual currencies and digital items, including but not limited to:

Virtual items and virtual currency have no real-world monetary value, are licensed and not sold, cannot be redeemed for cash, and are non-transferable unless expressly permitted by Tinibo LLC.

Balances, items, rewards, and virtual benefits may be modified, revoked, corrected, replaced, reset, or discontinued at any time to maintain the integrity and operation of the Service, subject to applicable law.

7. Subscriptions

Scripture Duck may offer recurring subscriptions, including individual and family plans. Subscriptions may provide benefits such as expanded customization, custom verse lists, reduced gameplay limitations, enhanced access, or other premium features.

Subscription features, pricing, benefits, eligibility, and availability may change over time, subject to applicable law and platform policies.

Subscription billing is handled by the applicable platform provider, including the Apple App Store or Google Play Store. Subscriptions automatically renew unless canceled before renewal through the applicable platform.

Refunds, cancellations, renewal terms, and billing disputes are governed by the applicable platform provider’s policies and applicable law.

8. In-App Purchases

The Service may offer optional in-app purchases, including virtual currency, digital items, consumables, cosmetic items, or other digital benefits.

All purchases are final except where required by law or platform policy. Prices may change at any time, and you are responsible for applicable taxes and fees.

Purchased or earned digital benefits may depend on your account status, device, platform, subscription status, and continued availability of the Service.

9. Digital Goods, Account Data, Guest Data, and Data Deletion

The Service may include virtual currency, digital items, progression data, subscriptions, streaks, achievements, journal content, and other account-related or device-related data (“Digital Goods”).

We do not guarantee that Digital Goods, account progress, journal content, guest data, or purchase entitlements will always be available, error-free, synchronized, transferable, recoverable, or permanently preserved.

9.1 Guest Access Data Loss

For users utilizing Guest Access, anonymous access, or shared family subscription codes without a registered account, data may be linked exclusively to the current device installation or local identifier. Deleting the Service from your device, clearing local app data, losing your device, switching devices, or removing the local identifier may permanently and irretrievably sever access to that data.

Tinibo LLC may be unable to recover, restore, or transfer Guest Access data once the local identifier has been removed, lost, or invalidated.

9.2 In-App Warning for Guest Journaling

If journaling is available through Guest Access, journal entries may be stored or associated with a local device identifier and may be permanently lost if the app is deleted, local app data is cleared, the device is lost, or the user later switches devices without linking to a registered account.

9.3 Data Sunset Policy

To maintain system efficiency and security, Tinibo LLC reserves the right to delete unlinked Guest Access data associated with anonymous or inactive devices after twelve (12) consecutive months of inactivity.

9.4 Registered Account Deletion

Users may request deletion of their registered account and associated cloud data in accordance with the Privacy Policy and applicable law. Some information may be retained where necessary for legal compliance, security, fraud prevention, dispute resolution, backup integrity, or legitimate business purposes permitted by law.

To the maximum extent permitted by applicable law, Tinibo LLC is not liable for loss of Digital Goods, account progression, journal content, virtual currency, streaks, leaderboard positions, or purchase entitlements resulting from software bugs, synchronization issues, platform outages, unauthorized account access, device loss, service interruptions, third-party provider failures, maintenance, exploits or abuse mitigation, or account enforcement actions.

We reserve the right to correct errors, adjust balances, revoke improperly granted items, reset progression systems, remove fraudulent leaderboard entries, disable abused access codes, and restore account or Service integrity where reasonably necessary.

Nothing in these Terms limits any non-waivable consumer rights provided under applicable law or platform policies.

10. User Content and Private Journaling Features

You may submit or store content through the Service, including usernames, profile information, verse lists, journal entries, notes, reflections, and feedback (“User Content”).

Journal entries are intended to be private to the account holder or Guest Access user and are not publicly visible or shareable through the Service.

You retain ownership of your User Content. By submitting or storing User Content through the Service, you grant Tinibo LLC a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, back up, transmit, and process that content solely for the purpose of operating, maintaining, securing, supporting, backing up, and improving the Service.

You are solely responsible for the User Content you submit or store. You agree not to submit User Content that violates laws, infringes intellectual property rights, or contains unlawful, abusive, threatening, or harmful material.

We do not guarantee the permanent availability, preservation, or absolute security of User Content, including journal entries. Although journaling features are intended to be private, no electronic storage or transmission system can be guaranteed completely secure.

We reserve the right to remove content or restrict access where reasonably necessary for safety, legal compliance, abuse prevention, security, support, or operation of the Service.

11. Leaderboards and Multiplayer Features

Leaderboard rankings, challenge outcomes, streaks, rewards, and competitive results may be adjusted, reset, modified, or removed at any time.

We reserve the right to investigate suspicious gameplay and remove fraudulent scores, exploited rewards, automation, abuse, or unauthorized activity.

12. Intellectual Property

The Service and all related content, including software, graphics, logos, game mechanics, artwork, audio, text, characters, names, designs, and branding, are owned by Tinibo LLC or its licensors and are protected by intellectual property laws.

You may not copy, distribute, modify, publicly display, create derivative works from, or otherwise use any part of the Service except as expressly permitted by these Terms or by Tinibo LLC in writing.

13. Bible Translations and Religious Content

Scripture Duck may include Bible verses, translations, religious materials, or related educational content licensed from third parties or made available under applicable permissions.

All rights to Bible translations and third-party religious content remain with their respective owners and licensors. Availability of translations, verses, or content may vary by region, platform, license, or Service version.

14. Privacy and Communications

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and processing of information as described in the Privacy Policy.

We may send account-related, security-related, transactional, and service-related communications. If you choose to subscribe to news and updates, we may also send optional promotional or informational communications in accordance with your preferences and applicable law. You may opt out of optional promotional emails using the unsubscribe method provided in those communications.

15. Third-Party Services

The Service may rely on third-party infrastructure, analytics, authentication, payment processing, cloud hosting, notification, email, and platform providers.

We are not responsible for interruptions, errors, outages, delays, data loss, or failures caused by third-party services, platform providers, networks, devices, app stores, or operating systems.

16. Platform Terms: Apple App Store and Google Play Store

If you access or download the Service through the Apple App Store, Google Play Store, or another app platform, your use of the Service may also be subject to that platform’s terms, policies, and payment rules.

We do not guarantee uninterrupted access to the Service. Features may be modified, suspended, discontinued, limited, or removed at any time.

Maintenance, updates, security issues, technical failures, third-party outages, or operational needs may temporarily or permanently affect availability.

18. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

To the maximum extent permitted by applicable law, Tinibo LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, and error-free operation.

We do not guarantee that the Service will be uninterrupted, secure, accurate, complete, compatible with your device, or free from defects.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Tinibo LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of data, account loss, service interruptions, loss of Digital Goods, loss of journal content, purchase entitlement failures, or inability to access the Service.

To the maximum extent permitted by applicable law, Tinibo LLC’s total liability for any claim arising out of or relating to the Service or these Terms shall not exceed the greater of: (a) the amount you paid to Tinibo LLC through the Service during the twelve (12) months preceding the claim; or (b) fifty U.S. dollars (US $50).

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.

20. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Tinibo LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:

21. Dispute Resolution and Binding Arbitration

Please read this section carefully because it affects your legal rights.

To the maximum extent permitted by applicable law, you and Tinibo LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration instead of in court, except that either party may bring an individual claim in small claims court if the claim qualifies.

You and Tinibo LLC waive the right to a trial by jury and the right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding.

Arbitration will be conducted on an individual basis in New York, unless the parties agree otherwise or applicable law requires a different location or method. The arbitrator will have authority to resolve disputes about the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that courts may decide issues relating to the class action waiver where required by law.

Before starting arbitration, the party raising a dispute must first send written notice describing the claim and proposed resolution. The parties will attempt to resolve the dispute informally for at least thirty (30) days after notice is received.

If any part of this arbitration section is found unenforceable, the unenforceable portion will be severed, and the remaining portions will remain in effect to the maximum extent permitted by law.

22. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles, except where applicable law requires otherwise.

23. Termination

We may suspend or terminate access to the Service, restrict features, remove content, revoke Digital Goods, or revoke specific family subscription access codes at any time if we believe there has been a violation of these Terms, fraud, abuse, security risk, unlawful conduct, or misuse of the Service.

You may stop using the Service at any time. Termination may result in loss of access to accounts, Guest Access data, Digital Goods, subscription benefits, journal content, or other Service features, subject to applicable law and platform policies.

24. Changes to These Terms

We may update these Terms periodically. If we make material changes, we may provide notice through the Service, by email, or by other reasonable means.

Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms.
